Under the EU General Safety Regulation, driver drowsiness warning has been mandatory on all new vehicles since July 2024 and advanced driver distraction warning since July 2026. Those rules apply at registration, so they do nothing for vehicles already on the road — and with more than 1.5 billion of those worldwide and an average vehicle age near 13 years, waiting for fleet turnover means waiting decades.
What the rule actually says
Regulation (EU) 2019/2144, the General Safety Regulation, sets out a package of mandatory safety systems for vehicles sold in the European Union. Two of them are driver monitoring.

DDAW infers reduced alertness, largely from driving and steering patterns, and warns the driver. ADDW goes further and monitors visual attention directly — gaze direction and head pose — warning when the driver's eyes stay away from the driving task too long.
The reasoning behind it isn't controversial. Fatigue is estimated to be a cause in 10 to 25% of all road crashes in Europe. In the United States, NHTSA recorded 3,208 deaths in distraction-affected crashes in 2024, and its own economic-impact work suggests the real figure is likely well above 10,000 a year once under-reporting is accounted for. Roughly 13% of all crashes in 2023 involved distraction.
The gap the mandate leaves
Type approval regulation works on new vehicles. It has to — you can't retro-legislate a car that was built in 2019. Which means the rule is a statement about the vehicle fleet of 2040, not the one on the road this morning.
The scale of that gap:
- More than 1.5 billion vehicles are already in operation worldwide, depending on which categories you count. None of them were required to have driver monitoring.
- The average car in the United States is approaching 13 years old and the average is still rising.
- Fleet turnover is slow by design. Even after a safety feature dominates new-vehicle sales, it takes decades more before it dominates the vehicles actually driving. That's the well-documented pattern for every previous safety technology, from ABS to electronic stability control to ADAS.
So the honest reading of the mandate is: the problem has been officially recognised, a solution has been mandated for vehicles that don't exist yet, and the vehicles that do exist are unchanged.
What this means if you run a fleet
First, a clarification that saves a lot of confusion: the General Safety Regulation does not require you to retrofit anything. It places obligations on manufacturers at type approval. Adding driver monitoring to your existing vehicles is a risk and safety decision, not a compliance one.
That said, three things follow from the mandate that do affect you.
The standard of care has moved. Once regulators declare a safety system necessary on new vehicles, "we didn't have that technology" becomes a much weaker position after an incident — with insurers, with customers, and in the court of public opinion.
Your fleet will become mixed, slowly. New vehicles arrive with DDAW and ADDW built in. Older ones don't. You end up with two standards of driver protection inside one operation, and the drivers with the least protection are usually in the oldest vehicles.
Nothing in the regulation reaches the vehicles you don't own. Subcontracted, leased and gig vehicles turn over on someone else's schedule, if at all. Motorcycles and three-wheelers are a separate question again.
